Fineline Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and Mysthetic Inc. (“Mysthetic”, “we”, “us” or “our”) for your use of the Fineline mobile application and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of a workshop or business, you confirm that you are authorised to accept these Terms on its behalf.

2. The Services

Fineline is a digital ledger that helps jewellery workshops record the custody of materials such as gold, silver and stones, by weight and purity, as they move between owners, managers, karigars and vendors.

Fineline is a record-keeping tool. It does not hold, transfer, value, insure or verify any physical material, and it does not process payments. Weights, purity and other values in the ledger are only as accurate as the information entered by users.

3. Eligibility and accounts

• You must be at least 18 years old to use the Services.
• You sign in with your mobile phone number. You are responsible for keeping your phone and SIM secure and for all activity under your account.
• You must provide accurate information, including your real name, so that other members of your workshop can identify you.
• Tell us promptly at privacy@mysthetic.com if you believe your account has been used without permission.

4. Workshops, roles and responsibilities

• Owners and managers decide who may join their workshop, approve or remove members, configure materials and processes, and can see the workshop’s full ledger.
• Karigars can view and act on the entries and balances that involve them, including accepting or rejecting handoffs.
• When you accept an entry, you confirm that you received or handed over the material described. Accepted entries become part of the permanent ledger and cannot be edited or deleted; corrections are made with new entries.
• The workshop is responsible for the accuracy of its records, for obtaining any consents needed to add people (including vendors) to the ledger, and for complying with laws that apply to its business, including tax, hallmarking and record-keeping requirements.

5. Acceptable use

You agree not to:

• Enter false, misleading or fraudulent records, or use the Services to conceal theft or loss of material.
• Access another person’s account or a workshop you have not been approved to join.
• Interfere with, disrupt, reverse engineer or attempt to gain unauthorised access to the Services or their infrastructure.
• Use the Services for any unlawful purpose or in violation of these Terms.

We may suspend or terminate access for any account or workshop that violates these Terms.

6. Disputes between users

Fineline records what users enter and accept. It is not a party to, and does not resolve, disputes between workshops, karigars, vendors or other parties about material, wastage, losses or payments. Ledger records may help you resolve such disputes, but we do not guarantee that they will be accepted as evidence by any person or authority.

7. Fees

The Services are currently provided free of charge. If we introduce paid plans, we will tell you about the price and terms before you are charged, and you may choose not to subscribe.

8. Your content

You and your workshop keep ownership of the information you enter into the Services. You grant Mysthetic a limited licence to host, store, process and display that information only as needed to provide, secure and improve the Services, as described in our Privacy Policy.

9. Intellectual property

The Services, including the software, design, text, graphics and the Fineline name and logo, are owned by Mysthetic Inc. or its licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose under these Terms.

10. Availability and changes

We work to keep the Services available and accurate, but they may be interrupted for maintenance, updates or reasons outside our control. The Services require an internet connection. We may change, add or remove features at any time.

11. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR THAT LEDGER CALCULATIONS WILL MATCH PHYSICAL STOCK.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MYSTHETIC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MATERIAL, PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, OR FROM ANY ENTRY MADE OR ACCEPTED BY ANY USER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM.

13. Indemnity

You agree to indemnify and hold Mysthetic harmless from claims, losses and expenses (including reasonable legal fees) arising from your use of the Services, the records you enter, or your violation of these Terms or of any law.

14. Termination

You may stop using the Services and delete your account at any time through our Delete Account page. We may suspend or end your access if you breach these Terms or if we discontinue the Services. Sections that by their nature should survive termination will survive.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Mysthetic Inc. is incorporated, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date. If you continue to use the Services after changes take effect, you accept the updated Terms.
