Terms and Conditions for Flashpath

INTRODUCTION

Welcome to Flashpath! This document constitutes a legal agreement (“Agreement”) between you (“you” or “user”) and Mysthetic Inc. (“Flashpath,” “we,” “us,” “our”), the owner and operator of the Flashpath mobile application (the “App”) and the website located at flashpath.app (the “Site”). This Agreement defines our mutual rights and responsibilities.

Please read these Terms and Conditions and our Privacy Policy carefully and in their entirety before using our App or Site (collectively, the “Services”).

1. ACCEPTANCE OF AGREEMENT

By accessing, downloading, or using our Services, whether in the free or premium versions, you agree to be bound by these Terms and Conditions and our Privacy Policy. Each time you use our Services, you are reaffirming your acceptance of the then-current Terms and Conditions. If you do not agree to be bound by these terms in their entirety, you must immediately cease all use of the Services.

You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of our Services. You acknowledge that there is valid consideration for this Agreement and that you voluntarily intend to be legally bound by its provisions.

2. DISCLAIMER & NO GOVERNMENT AFFILIATION

Flashpath is a privately owned company and is not affiliated with, endorsed by, or sponsored by any government agency. All trademarks, logos, and brand names are the property of their respective owners.

The content provided on this Site and in our App, including all practice questions and study materials, is intended for educational purposes only. While every effort is made to ensure the accuracy of the information, users must refer to the latest official driver’s handbook from their respective state, provincial, or national licensing authority as the sole authoritative source.

Flashpath assumes no responsibility or liability for any inaccuracies in the material provided or for any individual’s performance on their official examination. Passing our practice tests does not guarantee you will pass the official test. Our program is a study aid designed to improve your chances of success, but the official driver’s manual and local laws always govern.

3. LIMITED LICENSE AND PERMITTED USE

We grant you a non-exclusive, non-transferable, revocable license to access and use our Services strictly in accordance with this Agreement. Your account and all associated content are for personal, non-commercial use only, specifically for preparing for your chosen driver’s license or permit test.

Flashpath reserves the right to monitor account usage. If an account is accessed more frequently than what is considered average individual use, we reserve the right to block or terminate the account without notice. This license will automatically terminate if you violate any of these restrictions.

4. IN-APP PURCHASES, SUBSCRIPTIONS, AND REFUNDS

In-App Purchases & Subscriptions: Our App may offer premium features through one-time purchases or automatically renewing subscriptions (“Premium Services”). All payments are processed through the respective app store (Apple App Store or Google Play Store).

Automatic Renewal: If you purchase a subscription plan with automatic renewal, your subscription will continue to renew for the selected period unless you turn off auto-renewal through your app store account settings at least 24 hours before the end of the current period. It is your responsibility to manage your subscriptions. Flashpath is not responsible for refunding charges incurred due to failure to cancel an auto-renewing subscription.

Cancellation: You may cancel your Premium Services at any time through your Google Play or Apple App Store account settings. Cancellation will be effective at the end of the current billing cycle.

Refund Policy: Due to the digital nature of our Services and the costs associated with account maintenance, Flashpath operates on a standard no-refund policy. Refunds are only considered in exceptional circumstances at our sole discretion, such as a verifiable technical issue that prevented the delivery or use of the purchased Service. To be considered for a refund, you must contact our support team promptly to attempt to resolve the issue.

5. INTELLECTUAL PROPERTY

All content included as part of the Services, such as text, graphics, logos, images, as well as the compilation thereof, and any software used in the App, is the property of Mysthetic Inc. or its suppliers and is protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices.

6. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, FLASHPATH DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

FLASHPATH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. IN NO EVENT SHALL FLASHPATH OR MYSTHETIC INC. BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SERVICES.

7. AMENDMENTS

We reserve the right to amend this Agreement at any time without specific notice to you. The latest version of this Agreement will be posted on our Site and App, and you should review it prior to using the Services. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms and Conditions.

8. ENTIRE AGREEMENT

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Flashpath regarding the use of the Services and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us.

9. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of [Insert Your Jurisdiction, e.g., the Province of Ontario, Canada], without regard to its conflict of law principles.

10. YOUR DATA PROTECTION RIGHTS AND ACCOUNT DELETION

You have the right to request the deletion of your account and all associated personal data from our systems.

Upon receiving your request, we will verify your identity to ensure the security of your account. Once verified, we will proceed with the permanent deletion of your Personal Data from our active databases within a reasonable timeframe.

Please note that account deletion is irreversible and will result in the loss of all your progress, purchase history, and access to the Services.

We may retain certain information as required by law or for legitimate business purposes, such as resolving disputes, enforcing our agreements, or for financial record-keeping related to past purchases.
